Exclusions and suspensions following allegations

If your son or daughter has been suspended, excluded or asked "not to return" to school or college following an allegation still under investigation, we may be able to assist.

Sadly families can be left waiting for the determination of a police enquiry for months. This is often very stressful. But inevitably, the situation becomes more difficult to cope with if a school or college feel that exclusion is warranted simply because the young person is "suspected" of committing an offence but has not been charged with any allegation. Your child may vehemently deny the claims, but you will find that the phrase "innocent until proven guilty" does not feature at all when initial safeguarding decisions are being made.

Schools and colleges face tough decisions where the complainant and the alleged perpetrator of an offence attend the same establishment, needing to balance both the duty to safeguard and the right to educate. Families can quickly feel overwhelmed when trying to wade through policy documents, guidance documents and risk assessments to ensure their voice is heard. We can help ensure that your child's rights are not simply brushed aside.

Serious complaints about how a school has handled a particular situation

Making any complaint can cause an individual concern and worry. We can assist with initial complaints, appeals and ultimately advise on Judicial reviews or court proceedings where serious issues remain unresolved.

Judicial Reviews of decisions made by schools and colleges

Decisions made by public bodies (including private schools) must be lawful, rational, reasonable, fair and proportionate. Where there is no legal basis to support a decision, or it is contrary to the legal framework, it may be subject to legal challenge.
