What Is A No-Fault Divorce?

A no-fault divorce refers to the legal process of ending a marriage without assigning blame or fault to either party.

It is based on the principle that a marriage can break down without one person being solely responsible.

In a no-fault divorce, the focus shifts from proving wrongdoing to seeking a peaceful resolution and minimising conflict.

This approach allows couples to dissolve their marriage more amicably and cooperatively to promote fairness and reduce emotional distress.

Benefits of No-Fault Divorce

No-fault divorce significantly benefits couples seeking to end their marriage in a more amicable and cooperative manner.

Firstly, it eliminates the need for one party to assign blame to the other, removing the potential for escalating conflicts and resentments.

By focusing on the practical aspects of the divorce rather than fault-finding, couples can maintain a more respectful and dignified approach throughout the process.

This, in turn, helps to minimise the emotional impact on both parties, particularly the children involved and facilitates a smoother transition to post-divorce life.

Furthermore, no-fault divorce encourages open communication and negotiation, fostering a more cooperative atmosphere where couples can reach mutually beneficial agreements on important matters such as child arrangements, financial arrangements, and property division.

Ultimately, the benefits of a no-fault divorce lie in promoting a more compassionate and less adversarial approach to marital dissolution, allowing couples to move forward with their lives more harmoniously.

How Much Will A No Fault Divorce Cost?

Monan Gozzett recognises that applying for a divorce can be very stressful.

We want to offer our clients a high-level, personal, stress-free, and expert service, so we offer a fixed-fee package for clients wishing to apply for a no-fault divorce.

We offer a fixed fee service of £600 + VAT when acting on behalf of Petitioners/applicants in a no-fault divorce. Similarly, we can offer a reduced fixed fee service of £400 + VAT when acting on behalf of respondents in a divorce.

A fixed fee is a one-off payment made at the point of instructing us, which will include the whole divorce process, from applying for a divorce to the point of the final order being made.

We take care of it all so that you can concentrate on yourself and your family.

The fixed fee does not include the court-issue fee for a divorce of £593. Nor does it include representation concerning matters that need to be resolved in connection with the divorce, such as matrimonial finances and arrangements for children of the marriage.

Frequently Asked Questions About No-Fault Divorces

How long does a no-fault divorce take?

The duration of a no-fault divorce can vary depending on several factors, including the case's complexity, the cooperation of both parties and the court's caseload. A straightforward no-fault divorce can take between four to six months. However, it's important to note that the timeline can be longer if there are additional issues to resolve, such as child arrangements or financial matters. Can a no-fault divorce be contested?

In a no-fault divorce, the grounds for divorce are based on the irretrievable breakdown of the marriage rather than assigning blame to one party. As such, it is generally more challenging to contest a no-fault divorce. However, it is still possible for one party to contest certain aspects of the divorce, such as child arrangements, financial settlements, or property division. In such cases, it may be necessary to seek legal advice to navigate the contested issues and reach a resolution.

When were no-fault divorces introduced?

In England and Wales, the concept of no-fault divorce was introduced through the Divorce, Dissolution and Separation Act 2020. This Act received royal assent on 25 June 2020 and came into law in April 2022.

Do both parties have to agree to a no-fault divorce?

In most jurisdictions, both parties do not have to agree to a no-fault divorce. The key requirement is that one party believes the marriage has irretrievably broken down, supported by one of the specified reasons outlined in the relevant legislation. While the consent of both parties can streamline the process, the absence of mutual agreement does not necessarily prevent the initiation of a no-fault divorce. However, it is advisable to consult with a family law solicitor to understand the specific requirements and implications of a no-fault divorce in your jurisdiction.
