Neal Gozzett secures dismissal of case after making complex legal argument prior to commencement of trial under section 78 of the Police and Criminal Evidence Act 1984. His submissions asserted that if the evidence was to be admitted at trial, it would have such an adverse effect on the fairness of the proceeding and should not be admitted. His submissions were accepted and the court dismissed the case against his client.
